Filing a DMCA Takedown Notice
If you are a copyright owner (or an agent authorized to act on behalf of the copyright owner) and believe that content on the Vivian Clothing website infringes your copyright, you may submit a written DMCA takedown notice to our designated agent. Your notice must include all of the following information to be considered valid under the DMCA:
- Identification of the copyrighted work: A clear description of the copyrighted work that you claim has been infringed. If multiple works are involved, provide a representative list.
- Identification of the infringing material: The specific URL(s) or a detailed description of where the allegedly infringing material is located on our website, with sufficient detail for us to locate it.
- Your contact information: Your full legal name, mailing address, telephone number, and email address.
- Good faith statement: A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- Accuracy statement: A statement, made under penalty of perjury, that the information in your notification is accurate and that you are the copyright owner or authorized to act on behalf of the copyright owner.
- Signature: A physical or electronic signature of the copyright owner or authorized representative.
Important: Under Section 512(f) of the DMCA, any person who knowingly and materially misrepresents that material is infringing may be subject to liability for damages, including costs and attorneys' fees. Please consider whether the use of the material constitutes fair use before filing a notice.

What Happens After We Receive Your Notice
Upon receiving a valid DMCA takedown notice, we will:
- Review the notice for completeness and compliance with DMCA requirements.
- Remove or disable access to the allegedly infringing material promptly if the notice is valid.
- Notify the content provider (if applicable) that the material has been removed and provide them with a copy of the notice.
- Confirm the action by responding to the complainant via email.
Counter-Notification Procedure
If you believe that material you posted or provided was removed or disabled in error, or that you have authorization to use the material, you may file a counter-notification. Your counter-notification must include:
- Your physical or electronic signature.
- Identification of the material that was removed and the location where it appeared before removal.
- A statement under penalty of perjury that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification.
- Your name, address, telephone number, and email address.
- A statement that you consent to the jurisdiction of the federal court in the district where your address is located (or, if outside the US, in Multnomah County, Oregon) and that you will accept service of process from the party who submitted the original takedown notice.
Send your counter-notification to the same designated agent address listed above with the subject line "DMCA Counter-Notification."
Upon receiving a valid counter-notification, we will forward it to the original complainant. If the complainant does not file a court action within 10 – 14 business days, we will restore the removed material.
Repeat Infringers
In accordance with the DMCA and our internal policies, Vivian Clothing maintains a policy of terminating the accounts or access of users who are determined to be repeat infringers of copyright. We reserve the right to remove any content and restrict any user at our sole discretion.
